General Disclaimer – AEQUITATE WEBSITE and the POPI Act

AEQUITATE would like to welcome you to its website.

Whenever you use the AEQUITATE WEBSITE, complete an application form, contact us electronically or use one of the services or facilities offered by us, and provide us with personal information as may be required, we process your personal information.

The POPI Act (Protection of Personal Information Act) states that whenever we process your personal information when you use the AEQUITATE WEBSITE or any of the other forms whereby personal information may be processedAEQUITATE is obliged to:

  • Notify you of your rights & obligations regarding AEQUITATE’s processing of your personal information;
  • Notify you of our rights and obligations when AEQUITATE processes your personal information; and
  • Notify you of AEQUITATE’s obligation to request your consent for AEQUITATE to process your personal information.

The important terms to understand here are the following”:

“Consent” means that you voluntarily provide us with your permission to process your personal information.

“Personal Information” means information that identifies or relates specifically to you, for example, your name, age, gender, identity number and contact details.

“Process-, Processing- or Processes” of personal information means when AEQUITATE collects, received, records, organises, collates, stores, updates, modifies, retrieves, alters or use your personal information.

“Information Officer” means AEQUITATE delegates trained and authorized to process your personal information as required by the POPI Act.

AEQUITATE shall take all reasonable measures to protect the personal information of users and to comply with the requirements of processing of such personal information.

By viewing this “Insert Form of Communication” you hereby acknowledge that you (the User) have read and accept the following Protection of Personal Information Act (POPIA) disclaimer and consent to AEQUITATE’s “use” and or “processing” of your personal information as prescribed by POPIA. Please also see requirements aligning hereto as per the Promotion of Access to Information Act (PAIA) – (Please see PAIA @ www.gov.za/documents/acts).

AEQUITATE processes the User’s personal information primarily for AEQUITATE’s business purposes, which may include, but are not limited to:

(1) To communicate requested information to the User

(2) To provide services to the User as requested by the User

(3) To authenticate the User

(4) To provide the User with access to restricted AEQUITATE electronic or social media portals and or websites.

The personal information that AEQUITATE processes is stored in databases that have built-in safeguards to ensure its privacy and confidentiality.

Users should contact our information officer for any queries or if further information is required regarding our “use” and or “processing” of personal information, and / or if a User believes we are not compliant with the terms of the POPIA and or PAIA to enable us to address the concern raised. Users may also follow recourse as prescribed by the relevant acts.

The AEQUITATE accepts no liability whatsoever for any loss, damage (whether direct, indirect, special or consequential) and/or expenses of any nature whatsoever which may arise as a result of, or which may be attributable directly or indirectly from information made available on these pages or links, or actions or transaction resulting therefrom.

The User, by accessing and or viewing the AEQUITATE WEBSITE, hereby agree and consent to AEQUITATE’s use and process of my personal information as stated herein. The consent herein is extended to any personal information provided by me of 3rd parties, including but not limited to my spouse and or partner, minor child or any other person or entity, and I confirm that I have authorised consent from such 3rd parties to have access to – and to provide such 3rd party’s personal information to AEQUITATE and that AEQUITATE may use and process such personal information.
