The President proclaimed that effective 1 November 2019, fathers and adoptive parents may claim for parental leave benefits for ten consecutive days off work, from the Unemployment Insurance Fund. The Department of Labour shall determine the percentage contribution towards payment for parental leave benefits.
Employers need to:
- amend their policies to provide for parental leave for fathers and adoptive parents; and
- decide whether they shall top up the short fall between the UIF benefit and the employee’s usual remuneration for the ten day leave period.
The lacuna is that the effective date, amending the Basic Conditions of Employment Act, to provide for parental leave, was not included in the proclamation published on 29 October 2019.
